Texas Community and Separate Property
Texas is a community property state, meaning that there is a presumption by the court that all property acquired during the marriage is characterized as community property, which can be divided between the spouses upon divorce. People often believe that their individual income belongs solely to them. This is not true in Texas. For instance, if only one spouse had a job during the marriage, that income and assets acquired with that spouse's income would still be considered community property and divided between the spouses.
As previously stated, in Texas there is a presumption that all property obtained during the marriage is community property. However, you may have property that you inherited, had before the marriage or was a gift. If so, you have a claim for separate property. If you have property that qualifies as separate property, you have to prove it properly in court to overcome the community property presumption. Once properly proven in court, a judge won't divide a person's separate property, which can be very important in certain circumstances.
